Do you worry about hiring an attorney to represent you to in your traditional or non-traditional family law issues? Does the thought of going to court concern you about the impact on your family? There are options other than litigation (or courtroom appearances) to resolve the needs specific to your family.

Today I am fortunate enough to travel to Bellingham, Washington, to take part in a five-way Collaborative divorce meeting. The opportunity for our clients to “un-couple” in a safe place is a life-changing experience for the clients and the attorneys. For more information on Collaborative divorce, please visit http://www.collaborativepractice.com, to determine if the Collaborative process is appropriate for your family’s needs for a dignified and respectful un-coupling.

A couple of years ago the Snohomish County Superior Court started requiring that family law cases go through mediation before one of the parties could get a trial date. The rule was amended and now requires mediation before someone can tell the Court Administrator that they are ready to go to trial, which is approximately two weeks before the trial date. There exist very narrow exceptions to the requirement and the exceptions include a history of domestic violence or “good cause shown.”

The entire text of this new rule [SCLSPR 94.04(h)] can be found here.

The Alternative Dispute Resolution (ADR) requirement has created an increased need for Family Law mediators in Snohomish County and has created a corresponding opportunity for family law attorneys to transition to a more settlement-oriented business. The roles of divorce mediator and divorce lawyer often require quite different skill sets. The former requires an ability to set aside what often has become a “war” in order to help resolve the legal issues between the parties. The latter, while often necessary, requires vigorous and often contentious representation and advocacy. While they are two distinct skill sets, they are not mutually exclusive and we as lawyers and mediators greatly enhance our practices with further training.

This is why I am so excited about the April 20, 2012 advanced Family Law mediator training. I have assembled a “rock star” lineup of local and regional mediation/Collaborative Law trainers – many of whom enjoy an international reputation for their skills.

We will spend the day further developing our Family Law mediator skills with sessions about the roles of gender and culture in mediation; the importance of being self-aware while mediating; the unique contributions a Certified Divorce Financial Planner can bring to the mediation table; and, the skills to help “uncoupling” spouses communicate during mediation. Ultimately, we will incorporate the above skills to tackle a real-life mediation session. I am grateful to all the presenters who have graciously offered their time and skills to “raise the bar” and further develop the skills of the county’s Family Law mediators. They are performing an invaluable community service by helping us to become more effective at “The Table.”
